WAIVER – I agree that I am participating in Exsurgo training sessions at my own risk. I agree that my Personal Trainers are not liable for any injuries or damage that may result from my participation in these sessions. I further agree that my Personal Trainers will not be subject to any claim, demand or damages including those damages resulting from acts of active or passive negligence on the part of Exsurgo, its owners, coaches or employees. I agree that data collected from assessments and other activities can be used to develop programs and used for academic research purposes so long as my identity is removed.
CANCELLATIONS – I understand that all cancellations require a 24 hour notice. I understand that if I do not arrive for an appointment or provide adequate notice of cancellation I will be charged for the scheduled session.
APPOINTMENTS – I understand the importance of being on time for an appointment. In the case that I am late for an appointment the Personal Trainer will wait 20 minutes from the scheduled time of appointment. After this period of time the Personal Trainer is free from the obligation and I will be charged the full amount of the scheduled appointment. If the Personal Trainer is more than 20 minutes late for a scheduled appointment that particular session will be provided at no charge to me and I will receive one complimentary session.
REFUNDS – All payments are non-refundable and non-transferable.
EXPIRATION – Training session packages expire 12 months after purchase if not utilized.
CHILD SAFETY – I understand that I bring my children with me at my own risk. . I agree that my Personal Trainers are not liable for any injuries or damage that may result from them being in the gym. I further agree that my Personal Trainers will not be subject to any claim, demand or damages including those damages resulting from acts of active or passive negligence on the part of Exsurgo, its owners, coaches or employees.
COVID-19 – The risk to have contact with individuals, who have been exposed to and/or have been diagnosed with one or more communicable diseases, including but not limited to COVID-19 or other medical conditions, diseases, or maladies does exist, and it is impossible to eliminate the risk that I could be exposed to and/or become infected through contact with or close proximity with an individual with a communicable disease. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume all full responsibility for my participation. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest Personal Trainer immediately.
PHOTOS – I hereby grant permission to Exsurgo to use photographs and/or video of me taken at Exsurgo in publications, news releases, online, and in other communications related to the mission of Exsurgo and Exsurgo Technologies.
DATA COLLECTION – I hereby grant permission to Exsurgo to use biometric and assessment/training data collected on me at Exsurgo in publications, news releases, online, and in other communications related to the mission of Exsurgo and Exsurgo Technologies.
NOTICE TO CANCEL MEMBERSHIP – I agree to give Exsurgo 30 days’ notice of my intent to cancel my membership. I understand that I may still be billed within this time period and any credits remaining after the date of cancellation will not be refunded.
